5/ The EHRC could have said that Schedule 3 is ultimately unworkable, and that the Supreme Court was wrong to rely on a schedule that could easily be amended to produce a uniform meaning contrary to the purpose found in the main body of the Act. They chose not to.

4/ The present, unsatisfactory state of the statutory regime means that whether a person is trans can only be established through privacy-invasive litigation. A duty bearer has nothing to rely on except the perceived risk that a user (whether cis or trans) might bring a claim.

2/ In one of the pre-action letters, I told the EHRC that they would be failing in their duty to monitor the effectiveness of human rights and equality enactments if they pretended that the Supreme Court decision could be made workable without trans people voluntarily waiving their human rights.

1/🧵 According to the leak reported by The Times, the EHRC’s draft Code of Practice states that there is no document in this country that proves biological sex, and that trans people may refuse to disclose anything.

Of course, the only way to get around the problem the national equality body has identified - you can’t tell, just by looking at people - could most efficiently be resolved by legally compelling the targeted minority group to wear an identifying badge of some kind.
