A lot of people are dunking on Kavanaugh for this, but that is uncharitable and I, for one, encourage him to continue explaining his thinking in writing, in detail, in absolutely every forum he can. Give this man a Substack!
Kavanaugh goes out of his way to pen a footnote not having to deal with the case at hand.
