This was the core of Dred Scott, that the founders meant the word citizen to only mean white settlers.

And 14th Amendment birthright citizenship clause was an explicit repudiation of that, that all born here have an equal claim on what it means to be an American

There's that part in 1231 where they get to decide to ignore a designation if they determine it prejudices the United States, which they would undoubtedly say because they're sociopaths.

The Supreme Court denied cert today in a complicated and controversial case involving federal Indian law, Apache Stronghold. This case, brought by a nonprofit and not a Native nation, focused closely on the Religious Freedom Restoration Act (rights) over the treaty violations (power).
