New paper 📢. I have been pondering AI's effect on legal needs for the last couple of years. While AI has promising uses in law, I argue that, without regulatory intervention, it will worsen the access to justice crisis because of uptake in an unequal and adversarial justice system. The third time is a charm, I guess.
That December vote is a huge moment we can turn into a victory. People are watching. Good bill, we win; they cheat, they will lose. If we fight united.

Some thoughts on the CR/minibus.
1 The Dems negotiating with Rs were not freelancing. They coordinated with Sen Schumer. A few were ready to give in on day one, others worked to maximize appropriations wins.
Those voting for the 'deal' are the ones furthest away from electoral consequences.

While Trump and his minions are the biggest threat to Americans, it makes little sense to protest them if the opposition party continues to stab protesters in the back. I'm not seeing a viable path forward without internal revolt against Schumer and other capitulators.

"Why are people so cynical about politics?"
Republicans had predicted that Democrats would cave on the government shutdown as soon as the election was over because they were only keeping the standoff going to motivate their base.

Let’s be clear: Chuck Schumer is the one ending this shutdown, no matter how the votes read.
Chuck Schumer is claiming that he’s voting no, while letting other Senators (Fetterman, Kaine, King, etc) do HIS dirty work.
He must be removed from his leadership & primaried for the sake of this country

The Art of War advises that when your enemy is self-immolating, rush to grab a bucket. @schumer.senate.gov has outdone himself once again.
I assumed that since Schumer asked for such a pathetically low number on the ACA extension (1 year) it would get whittled down to maybe four months and pinky promises.
But if this reporting is accurate, they're not even going to try for four months. They're just going to take the pinky promises.

👇 Schumer never wanted the shutdown and is ending it before Americans realize what the administration has done with SNAP payments.

Random legal thought. How does one reconcile the existence of a vindictive prosecution defense-mandated by due process-with the admonishment in Trump v. US to not consider the President's communications with the DOJ for purposes of criminal liability?

Whatever happens, @schumer.senate.gov needs to step down as minority leader. This is effectively what he proposed before Trump/Vought began their post-shutdown rampage.
JUST IN: Schumer will say today that Democrats would vote to end the shutdown in exchange for a one-year extension of expiring Obamacare tax credits, multiple sources told Axios.

I guess Cornell got a better deal than Columbia, but (1) it'd be impossible to get a worse deal than Columbia, and (2) it's still a shakedown -- Cornell is paying the government $30 million for no reason other than to get back grant funding. This is no way to run a university or a government.
Cornell agrees to pay $30 million dollars to the government and invest the same amount in agricultural research. Curious timing for a settlement. @mbkplus.bsky.social and I will surely have thoughts on livefromwatthall.transistor.fm

SCOTUS will probably strike down the tariffs, but let's be mindful of the long game. The Court's defenders, which include many Democrats, are going to cite the decision on tariffs and eventual merits ruling on birthright citizenship to argue that the Court is apolitical and does not need reform.
Supreme Court Justices from across the ideological spectrum raised issues with Trump’s tariff power grab.
His tariffs are a nearly $2,000 tax on every American family and should be repealed immediately.
