A human rights-based approach to the toxic drug crisis would require public policy that recognizes the full humanity of people who use unregulated drugs

which would be a whole new thing

full DULF trial decision: www.bccourts.ca/jdb-txt/sc/2...

a court that acknowledges defendants doing the right thing but still gives them a guilty conviction shows how broken the justice system is.

we needed safe supply in 2016. some of the few people who did something in 10 years might go to jail

Here is something no one is talking about in regards to 🇨🇦 ‘s loss of measles-free status: this was only possible because Con Premiers in provinces with vaccine mandates for children in school are no longer enforcing them. That is how Ford’s fight with the school boards started, they exposed him.

"DULF’s pilot project worked,” said the BC Supreme Court judge of the Vancouver compassion club.

She still convicted founders Jeremy Kalicum and Eris Nyx. But some of her comments "may provide fuel" for their upcoming constitutional challenge, reports @godfrey.bsky.social:

DULF saved lives. When BC shut them down, people died. They are fighting on the right side of history for sane drug policies for all Canadians. Pay attention to this Charter case. https://www.cbc.ca/news/canada/british-columbia/dulf-compassion-club-guilty-drug-trafficking-9.6972135

“There is no issue that the Crown has proven the essential elements of the offence of [possession for the purpose of trafficking],” Murray said. “However, this case is not that straightforward.”

DULF also demonstrated that people who use drugs taking care of each other was the truth path to saving lives and living with dignity. The real solution has been autonomy all along.

But politicians and capitalists hate autonomy because the foundational basis of their power is precarity via control.

In this past decade of mass death, there were timid steps in the right direction - at first. But the most coherent, passionate response from the state (and its various apparatus) has been to smash DULF, hire more cops & roll back what little harm reduction we had won.

The sad part is that the judge recognized DULF was saving lives and what they were doing was working. However, she had to decide if they were fully operating under an exemption for the Controlled Drugs and Substances Act. In her ruling she said the exemption covered testing, storing and packaging...

the DULF ruling makes my fucking blood boil. i hope everybody involved in ruining these people's lives are haunted by their actions for the rest of their own. the cops raiding their space and arresting them directly led to the deaths of several of the people they were helping. vile, putrid shit

This story is so consequential because of the political hit job their arrests & charges represent.

They were working in the open, validating their non-profit model with academic rigour.

But a right-wing moral panic built enough steam for VPD to drop the hammer. 2/

"DULF produced a peer-reviewed study that showed after about one year none of its compassion club members had died. Members reported having fewer overdoses and engaging in less crime."

Heartbreaking that Canada's criminal law prioritizes drug prosecution over saving human lives.

As @drugdatadecoded.ca reported, the judge noted DULF "are being hung out to dry. As soon as politicians started complaining, all of a sudden VPD [local police]—which before was fine—suddenly was not fine.” She nonetheless ruled on procurement and distribution? Legal hair-spitting over justice?
