OK, a roundup response to the "they won't follow the court orders" people.

First of all, you're wrong! The administration *is* following many of the court orders.

What's more, they're showing their understanding of the validity of court orders by seeking stays pending appeal when they lose.

Usually when states go to court alleging federal coercion in violation of the 10th Amendment there is not a literal video of the President doing it.

This is important. Not because Miller will ever be consistent in his pleadings for presidential power but because it’s a public service to demonstrate to anyone who might entertain a shadow of a doubt that there’s no neutral principle here. He wants power for his guy, full stop.

One thought on the Tik Tok oral argument that I haven't seen addressed after re-listening today.

Much turns on whether and how the Court addresses severability. The divestiture provision is likely not, standing alone, likely to raise any First Amendment issues. Foreign companies have no such right.

Two things are true:

1. The U.S. does not have the moral standing to justifiably criticize Israel about war crimes.

2. Bibi is even not even pretending to not commit war crimes here. That's how little pressure he feels to stop.
