I understand Gorsuch is citing the appendix. But he's supposed to accept the trial court's findings of fact unless the trial court abused its discretion. He's not supposed to judge anew the facts on the record.

I apologize for the last sentence in my first tweet. I don't agree with you at all but I should not have accused you of bad faith.

Is Gorsuch citing the district court's findings of fact? Is he citing facts J. Kennedy argued but Bremerton disputed? Who decided these facts are true? If they are true, they contradict Gorsuch saying Kennedy prayed quietly while students were otherwise occupied.

My colleague got into Trump's sprawling family detention camp, which is full of toddlers, kids, & teens.

- Kids have cut themselves or talked about suicide

-There's worms & mold in food

-300 kids have been held for 30+ days, far longer court settlement allows

But Gorsuch could not honestly find as a fact that Joseph Kennedy prayed quietly while students were otherwise occupied.
February 9, 2026 at 11:18 PM
Sure, hearsay if the kids didn't testify. But the test is whether a reasonable student would have felt coerced not whether any student actually complained of coercion. So Steve Kennedy can opine in this article the prayer was coercive. ...
February 9, 2026 at 11:18 PM
These prayers occurred on a sports field with parents, students, other educators & later press as witnesses and videos as documents. Their testimony couldn't be dismissed as hearsay so Gorsuch just ignored it & the record developed by the lower court to create his own fact set. Like you're doing.

U.K. might lose a prime minister because a guy who worked for him knew another guy who hung out with Epstein. Meanwhile the U.S. opposition party is telling our President, who was Epstein's best friend, that his secret police should get better training so their public street murders look less messy.

Britain has dethroned a prince, forced Mandelson to resign, & lost confidence in Starmer because Rep. Thomas Massie & I forced the release of the Epstein files.

What is America doing to hold the Epstein class accountable?

We need to haul these powerful men before Congress.
