there is no jurisprudence at work here. the republican court believes that anything a republican president is presumptively constitutional, even if it directly violates the unambiguous constitutional text and causes total chaos in law and policy.

i also think that it is only a matter of time before this court rewrites section 1 of the 14th to effectively end birthright citizenship. the 14th amendment is the chief obstacle to a legal regime of tiered citizenship and subordinate castes, and they will not let it stand.

If this is the level of subtlety that can lead to a religious liberty violation than, as Sotomayor points out, I don't see how any person can't bring a religious liberty claim to opt out of pretty much anything. Case in point: could Christian Scientists could now opt out of any book with doctors?

I've been banging this drum for years now, I know, but Zohran's Big Night is a clear illustration of the power of giving people a vision of the future that boldly contradicts the rhetoric of Republican fearmongers.
