The problem isn't that we can't talk to each other

The marketplace has heard the ideas

Large supermajorities reject them

Yet our anti-democratic political institutions allow the 20-25% that like those ideas to capture & control all the institutions

The problem is the anti-democratic institutions
CNN has a show with a similar line. That the problem with this country is we just aren’t talking to each other.

It’s the kind of diagnosis that a toddler would land on.

New from me in @thenation.com: Good news from Indiana aside, the gerrymandering wars will be decided by John Roberts. That‘s less great.

Indiana’s Gerrymander Victory Won’t Save Us
The Hoosier State’s Senate showed rare backbone in resisting the Trump White House’s demand for a mid-cycle gerrymander. But the Roberts court gets the final say.

Federalist No. 70 has/will come up a lot in the Roberts Court’s analysis of executive power. I dove into how SCOTUS has blithely misquoted and misread it along the way.
John Roberts and the Cynical Cult of Federalist No. 70
Alexander Hamilton’s treatise on executive power is one of the conservative legal movement’s favorite texts to quote—and misquote.

25 years ago today, five GOP justices who claimed fealty to states’ rights, and who were skeptical of a broad equal protection clause, told Florida it could not finish counting ballots despite the Florida SCT ruling to the contrary b/c of an equal protection principle never used before or since.

This should be the biggest story in the country right now. The sitting US President was extorting state lawmakers from his own party by threatening to withhold public money if they didn’t gerrymander for him.

I don’t know how else to say it…

Multiple Republicans are absurdly claiming they're just fighting back against Democratic gerrymandering.

In 2024, roughly 3 times more seats were in states drawn to favor the GOP than Dems.

The GOP in Congress & on the Supreme Court has repeatedly blocked efforts to ban gerrymandering nationwide

There's a pretty good argument that John Roberts misled Congress during his confirmation hearings when asked about his work on the Voting Rights Act reauthorization in 1982 as a young aide in Reagan's DOJ.

my measured conclusion upon review of the Supreme Court's order reimposing Texas's racially gerrymander is that the only thing the Republican justices hate more than district court judges is people of color voting

A federal district court found that Texas Republicans’ redistricting proposal is an illegal racial gerrymander. The conservative justices couldn't care less.
