So the younger shooter, in a video submitted to the court, claims the shooting was aimed at the Zionist policies of Israel as a state. This is distinct from being an attack against Jewish people as a group. Once again the pro-Zionist coalition and right wing media jumped the gun and got it wrong.

Wrote this re SCOTUS’s inevitably siding against Trump on birthright citizenship, but it also applies to tariffs and National Guard
What it will NOT mean is that suddenly the Roberts Court will have moderated. It is not moderating. It’s pursuing its own antidemocratic agenda to perpetuate Republican power well beyond his own time in office, and sides with Trump when his own empowerment and the issues he creates serve that agenda

The reason @martylederman.bsky.social’s brief was so effective is because it gave Roberts and Barrett (and Kav) a way to vote against Trump without calling him a fucking liar, which is what the lower courts based their decisions on

Every opinion makes good points about a president’s legal authority to call up the Nat’l Guard and the procedural concerns of resolving it on the shadow docket.

But they all ignore what the district judges knew these cases are really about: Trump’s bad faith invasion of our cities based on lies.

SCOTUS adopts @martylederman.bsky.social’s argument, which will also mean CA9 and CA7 will have to do so as well.

The upshot? If Trump wants to occupy our cities, he’s gonna have to send in the military by finding a way around the Posse Comitatus Act.

Trump’s DOJ says SCOTUS Bruen decision abrogated governing circuit precedent that upheld DC’s assault weapons ban in 2011.

The vote in that case was 2-1. Then-Judge Kavanaugh’s dissent introduced the history and tradition test that SCOTUS adopted in Bruen.

This post-Trump party looks a lot like the pre-Trump party (Art Pope!). And that party was already so politically exhausted and morally corroded that Trump could take it over with rank bigotry and faux-heterodoxy to deliver it two POTUS wins the party otherwise woulda lost.

This won’t change that.
Very interesting developments here. Pence + allies are moving to topple Heritage as the right's core think tank. That Heritage staffers wanted to join Pence, who bucked Trump on J6, but ostensibly over Kevin Roberts' embrace of Tucker Carlson, is not nothing. They're planning for post-Trump.
