I'm grateful that Kyle surfaced all these extraordinary opinions slamming the Trump administration for the illegal detention of immigrants. This one leaps out in part because the judge is warning us that abuses being inflicted on immigrants now are a preview of what could be unleashed on citizens.
A hypothetical posed at the Show Cause Hearing demonstrates the dystopian absurdity that could stem from the Government’s incorrect, unfounded interpretation of the law. By the Government’s own admission, its position is that if an ICE officer made a mistake and, pursuant to § 1225, detained somebody who was legally in the United States, that detainee would not be entitled to a bond hearing. Instead, that detainee—who is confined to a jail cell and may not have a mastery of the English language—could only have their case heard by a neutral judicial officer if they were somehow able to file a habeas petition with a Court of Appeals or the District Court of D.C. This concession should concern everyone. A threat to anyone’s constitutional rights is a threat to us all. Today, immigrants are being detained without due process. Tomorrow, under the Government’s interpretation of the law, American citizens could be subject to the same treatment. This Court will not allow such an unraveling of the Constitution.

DeKeseredy & Schwartz (2016) argue that perpetrators can be motivated by male bonding: journals.sagepub.com/doi/10.1177/...

(This article is specifically about image-based abuse, but DeKeseredy’s earlier work on male support theory is cited and built upon within it)
DeKeseredy and Schwartz (1993) revised it to take into account broader social forces. They assert that abusive patriarchal men situated in a patriarchal rape-supportive culture have male friends with similar beliefs and values who act to develop and then reinforce beliefs and values that promote the abuse of women, and in particular those women who represented a threat to male patriarchal authority (Schwartz & DeKeseredy, 1997). These men provide attachments to other abusive men, and resources that involve specific verbal and emotional support. This includes a vocabulary of motive that defines some women as legitimate objects of abuse and sexual assault. Nearly 30 years of international quantitative and qualitative research (as outlined in DeKeseredy & Schwartz, 2013) in a variety of contexts confirms that male peer support allows men to feel normal and justified when committing violence against current and former intimate partners.

What the public does not understand about these retaliatory cases is that what is on trial is the ability for men to abuse their power against women without consequence. When women lose defamation lawsuits for speaking up, men win the right to abuse with impunity

I love when the members of Congress - both Dems and Republicans - about things like whether ICE should have to use judicial warrants or be banned from deporting citizens like they're new.

These things are already the law! ICE just isn't following the law.

Rep. Mark Harris: "Some of these things are nonstarters. Having judicial warrants? To me, hat's a nonstarter. Being able to make off their mask, putting them at risk? That's a nonstarter. I would say anything that's going to hamstring the work of ICE, that's just not going to go anywhere."

Again, this is FALSE. Administrative warrants are NOT signed by an immigration judge (or any judge at all). They are generated and signed by ICE officers themselves with no external oversight whatsoever.

Here is a blank sample warrant. Note who signs off on it; an "immigration officer."
