One of the CBP agents definitely had the guy's gun before shots started going off. The agent's hands are empty when he starts grabbing at him, and he pulls a gun put from under the guy's shirt before the first shot goes off. He was unarmed when they shot him.

Texas with its grid problems hasn't had a widespread outage in a couple years thanks to how quickly we've incorporated utility-scale batteries into the grid. This is horseshit that shouldn't convince anyone who doesn't have to consciously remind themselves to breathe.
