The U.S. Law of War Manual, consistent with Lincoln’s ‘Lieber Code” and Article 40 of Protocol 1 of the Geneva Convention prohibits declaring "no quarter,” meaning it is forbidden to order that there shall be no survivors and requires that individuals no longer able to fight be spared.
