The strongest and most prosecutable case against those seeking to overturn the 2020Presidential election results and prevent the certification of those votes was the oneinvestigated and indicted by Special Counsel Jack Smith. Although Special Counsel JackSmith’s federal case encompassed evidence from multiple states, he ultimately concludedthe federal case could not be prosecuted because of the U. S. Supreme Court’s decision inTrump v. United States and the re-election of President Donald J. Trump.Special Counsel Jack Smith wrote in his report, “Conversely, a select few of Mr. Trump'sagents and elector nominees had insight into the ultimate plan to use the fraudulentelector certificates to disrupt the congressional certification on January 6 and willinglyassisted.... The federal government is the appropriatevenue for this prosecution, not the State of Georgia. Indeed, if Special Counsel Jack Smith,with all the resources of the federal government at his disposal, after reviewing theevidence in this case and considering the U.S. Supreme Court’s decision in Trump v.United States, along with the years of litigation such a case would inevitably entail,concluded that prosecution would be fruitless, then I too find that, despite the availableevidence, pursuing the prosecution of all those involved in State of Georgia v. DonaldTrump, et al. on essentially federal grounds would be equally unproductive.

Admittedly, the racketeering part of the ruling is focused primarily on Durham Report stuff.

But it overlaps with what Trump wants to charge in SDFL.
No “real relation” exists between any earlier proceeding and this suit. Trump presents as candidates the Federal Election Commission’s action against the Clinton campaign, Durham’s prosecution of Sussmann, and the Danchenko and Clinesmith prosecutions. None of these proceedings are, or even resemble, a racketeering action. At best, they are actions involving some of the conduct that Trump incorporates into his racketeering claim. But none of these actions are even prosecutions of a racketeering predicate act. The Commission’s action objected to the Democratic National Committee’s and Clinton campaign’s “mischaracteriz[ation] . . . of certain disbursements,” and at most establishes that the campaign relayed funds through Perkins Coie to opposition research. And the Sussmann, Danchenko, and Clinesmith prosecutions for making false statements to federal officials are relevant only to discrete parts of Trump’s claims. These facts do not amount to a racketeering enterprise or a racketeering conspiracy.
