The 14th Amendment also affirmed the citizenship of 500,000 free Black Americans who had been, for decades before the Civil War, denied citizenship (though born in the US.) And then the Amendment went further, in plain term, to provide that all persons born in the US are citizens of the US. 2/2

The Constitution is clear: people born in the United States are American citizens. Birthright citizenship is an undeniable right.

This is a concession by the U.S. government that its “arrangement” with El Salvador is irrevocable. To me this has to be grounds to argue that the arrangement itself is unconstitutional under the Fifth and Eighth Amendments
