It would absolutely be a mistake to use either having had bottom surgery or possessing a GRC to decide which trans people are going to have full human rights and civil liberties.

I entreat those members of the community who think this a good idea to withdraw their advocacy.

I really think that a lot of GCs believe that if they take away trans people's human rights that the motivation to transition will disappear. Not even just that if they make the world hostile for us we won't come out, but that if they make it hostile enough they'll "cure" dysphoria

This decision from the ECHR is lockstep in line with the decision in the CJEU from Hungary which I covered here.

The outcomes are the same because the logic of fundemental rights around privacy and Data Protection are the same.

The Uk is outside mainstream rights.

Trans *wrongness* is so embedded in every bit of guidance that it underpins the central tenet: that, contrary to international human rights law *and* UK law, trans people must be segregated for the safety and dignity of *everyone else*.

If you can't see the problem here, you're part of the problem.
One of the big issues (there are many) with the EHRC's draft guidance, from the excerpts I've seen (I still don't have the spoons to read it all) is this:

Like Cass, it's infused with the idea that being trans is somehow *wrong*; a problem to be *dealt with*. Trans people's humanity is invisible.
