While throwing a sandwich may technically be "assault" according to some readings of the law, it is always up to a jury to judge the law and what constitutes common sense justice.

Support #JuryNullification?

It's one thing to spread around the phrase, it's another to keep in-depth resources about it available online! The Fully Informed Jury Association has done immense work since 1989. But we depend upon donations from people like you!

We live in the dystopian world Dick Cheney made. Alligator Alcatraz, masked ICE agents disappearing brown people, blowing up random boats of people declared "enemy combatants" in a "war" with no borders, unfettered presidential power. Cheney created the lawless executive power Trump now exploits.

What Constitutes Jury Nullification?

This July, Sidney Lori Reid took her phone out and filmed as ICE agents took two people into custody from DC city jail. When she didn't comply with an order to move back, an officer shoved her into a wall and an FBI agent joined to pin her...

"disagree on proposed jury instructions — specifically, over what is required to prove misdemeanor assault, as well as the legal definition of assault under the statute"

That's because it's not possible for a jury to judge facts without also judging the law.

Jury nullification on the rise
I have written many times before about the practice known as jury nullification, where juries exercise their right to acquit people of violating a law even if they are plainly guilty. Juries do not…

Over the next several years, you will NOT dodge jury duty. You will answer voir dire questions truthfully, but don't need to tell someone how to build a watch if they ask for the time. When you're on the jury, you are free to decide the case based on your experiences. Google jury nullification.

The best response to mass arrests is to teach every potential juror in LA about their jury nullification prerogative. Did a protester push back against a cop? Were they out past curfew?

A juror may refuse to vote guilty whatever the evidence if they believe the law is unjust or wrongly applied.

"When the government acts aggressively, its agents lie, and the community witnesses the erosion of justice, that community’s informed distrust of the government’s actions is not a bias to be purged. It is the very voice the Framers yearned for"

There’s a principle called the presumption of regularity: it means that courts presume that the government will act lawfully and in good faith. With what we know about official misconduct leading to wrongful convictions and what we are seeing now, maybe it’s time to revisit this presumption.
“We found over 35 cases in which the judges have specifically said what the government is providing…false information. It might be intentionally false information, including false sworn declarations time and again," says Ryan Goodman, law professor at New York University.

Wow. Sidney Reid, the DC woman just found not guilty of assaulting an FBI agent, issues a withering and gutsy statement on Trump through her attorneys.

"I feel sorry for the prosecutors really, who must be burdened by Trump's irrational and unfounded hatred for his fellow man."

It's a must-read:

Three cheers for the Constitution's right to a jury: a federal jury in Los Angeles "took just over an hour to acquit [Brayan] Ramos-Brito of a misdemeanor assault count" in an ICE-scuffle case hinging heavily on the testimony of border sector chief Gregory Bovino, now doing raids in Chicago.
Yet another piece on the role of juries:

"No Kings" is a good impulse and a foundation for conversations about the importance of #jurynullification.
