The Supreme Court should preserve the status quo until legal questions are resolved and explain the disposition of cases for the public. They are abdicating basic principles of equity and failing to fulfill their institutional role. They aren’t pretending to try. There isn’t even the veneer of law.

New in PN: The worst chief justice of all time

"American history has no shortage of legendarily bad chief justices and disgraceful decisions. But John Roberts has overseen the wholesale corruption and capture of the Supreme Court, and history should look back on his tenure with revulsion."

With both middle fingers in the air, I dissent
the liberal justices keep floating these dramatic little sign offs on their dissents. “With sadness,” “with deep disillusionment.” just say “i dissent,” it reads more forcefully.
KBJ, in dissent, calls today's ruling "profoundly dangerous" and an "existential threat to the rule of law." She expresses her "deep disillusionment" with the court and suggests that the conservative supermajority continues to crown Trump a king above law. www.supremecourt.gov/opinions/24p...

Justice Sotomayor dissenting on birthright citizenship case: "The gamesmanship in this request is apparent and the Government makes no attempt to hide it. Yet, shamefully, this Court plays along. Because I will not be complicit in so grave an attack on our system of law, I dissent."

all of the Supreme Court’s jurisprudence about executive power - all of it - can be replaced with a simple flow chart. is the president a Republican? if so it’s ok. if not, it’s presumptively not ok.

I want to reiterate that countless conservative judges issued universal injunctions against the Biden administration, and the Supreme Court never halted the practice. Now, barely five months into Trump's second term, the court puts an end to these injunctions. A brazen double standard.

Today's Planned Parenthood decision was a devasting blow to women, and it wasn't even about abortion. It was a devasting blow to civil rights, and it wasn't even about Civil Rights.
It's one of the worst decisions from this SCOTUS, worse than you probably think.

The Supreme Court Has Dealt Another Devastating Blow to Women
The court's ruling in Medina v. Planned Parenthood twists logic, common sense, and the law to further the right-wing assault on bodily autonomy.

I will be damned if I allow a bunch of Confederate-waving January 6th apologists give the American people a lecture on flag waving.

There is ZERO reason to enter an argument about patriotism with people who still worship traitors to America 150+ years later.

They. Are. Breaking. The. Law.

Those on the high court often exercise caution in their choice of words. That is why it was striking when she used an audience of lawyers to deliver a stern message to the legal profession: stand up for democracy, take on the hard fights and do whatever you can to win.
Justice Sotomayor’s Message to Lawyers: Stand Up, Fight and Win
In an era when judges are often assessed by their commitment to democracy, Justice Sonia Sotomayor stands as a stalwart in the pro-democracy camp.

So, uh, which part of the Supreme Court decision allowing the government to force people into concentration camps is supposd to be "overruled"?
So, How Much of Korematsu Did the Supreme Court “Overrule,” Exactly?
In 2018, John Roberts called it “obvious” that Korematsu has “no place in law under the Constitution.” Recent events suggest otherwise.

I remember last year (maybe the year before that?), I tweeted that Korematsu was never explicitly overruled and a few lawyers disagreed with me on that.

SCOTUS could have made the language explicit. They did not. We pay for the sins of the past.
In 2018, John Roberts claimed that the Supreme Court had overruled Korematsu, the Court's decision upholding the internment of Japanese Americans during World War II. Recent events suggest otherwise! ballsandstrikes.org/scotus/korem...
