To issue this stay, 6 "justices" had to decide that the state of Texas would suffer greater harm from not being allowed to discriminate on the basis of race than would the voters of Texas who the state discriminated against on the basis of race. How have we become a country where this could happen?

The reason the judiciary functions is because judges understand that despite everyone being human beings who hold grudges and have stupid opinions and peccadilloes and flaws, there is a sense that you have to justify what you're doing on more than "because I say so."

This Court is undermining that.

I don't think the Justices understand the extent to which they are playing with fire. The more they do this, the more District Courts will engage in open disrespect of the Supreme Court, because what other response is there to open disrespect directed at them? That's bad for the Judiciary, period.

As Justice Kagan begins her dissent by pointing out, what is even the point of trial, of fact-finding, of clear error, of standards of review, when the Supreme Court simply ignores every single part of that and decides everything purely on the papers without any real consideration of the facts?

Think about how many people had to have been involved for the second boat strike to happen, from Trump and Hegseth to the admiral to the people in the air and in control centers. The idea that "none" of them knew the law is absurdly unbelievable.

Hegseth: I watch that first strike live. At the Department of War, we got a lot of things to do so I did not stick around. Couple of hours later, I learned that commander had made -- which he had the complete authority to do, he made the correct decision to sink the boat and eliminated the threat.
