Today, a lawyer buddy of mine asked me to look at a legal issue for him. I did. I told him he couldn't do what he wanted to do. I gave him citations.

He responded with the outputs from Claude and ChatGPT.

Both analyzed the issue incorrectly. Both gave him the answer he wanted to hear.

Dang. RIP, Jim Kimball, drummer with Mule, whose self-titled debut album I was heavily addicted to for much of 1993, the year it came out. He was half of the duo that went by the Denison/Kimball Trio. Also played with Jesus Lizard and Laughing Hyenas. A powerhouse.

Today’s settlement came as a surprise to many observers, myself included. The extent to which it reflects concern about parallel hacking/extortion issues remains to be seen. Either way, the reverberations should be interesting.

Eh, finding usurpation often requires speculation in these settings. I mean, there’s an entire line of cases addressing harm to potential or reasonably likely derivative markets. Maybe he's confusing it with the still-emerging markets for the AI output? Either makes for a dubious proposition.
Lee: Fair Use is a flexible doctrine designed to be applied in case-by-case manner. If authors show there is ACTUAL market harm based on the output of the model, they can bring another case! Judge Alsup said so! But the market harm right now is entirely speculative.
