Why Jasmin Paris should be #SPOTY24
She completed Barkley Marathons with 99 seconds to spare
- 33 Parkruns distance
- in a forest
- mostly off trail
- partially in dark
- no GPS watch
- ascended 2x height of Everest
- only 19 male runners have completed it in 29 years
- Jasmin was the 1st woman

Teaching vicarious liability this week. I can be critical of Scottish courts, but VL is one area where they have been exemplary. As @campbellmat1.bsky.social & BWML said in their recent article 'Few are the Scottish applications of the close connection test which surprise.' Which is a good thing.

Appreciate this may not be a universally popular opinion but the less you treat BlueSky as a crusade or cause, and the more you position it as simply a superior user experience with a better governance approach, the more sustainable the growth will be.

Defamation klaxon! New article just published. It's Open Access. Written by Dr Lindsay and me. We read tons of cases. It was glorious. So much fun to work on. The subject matter of the cases was neither fun or glorious.

Today I'm attending a seminar to honour the contribution to scholarship of Professor Kenneth McK. Norrie at the University of Strathclyde, entitled "The Person in Scotland and the World: 40 Years of Private Law Reform", supported by the Clark Foundation. Well done to colleagues for organising this.

Lots of hottakes on this case, of course! Here's mine: when the court says 'duty of care' it is being impressitionistic. It does not equate to the same legal concept we use in common law jurisdictions. (I've already noticed several law firm updates neglect to clarify this point, which is vital).
Here is a direct link to The Hague Court of Appeal decision in Shell plc v Foundation for Environment and People: uitspraken.rechtspraak.nl/details?id=E.... I like to review the source itself. Chrome translates automatically.
