It's shocking to me how often I've cited or reposted CATO in the past 8 years, but they have the goods. If they joined with progressive democrats, we'd have some real capacity.
In Lackey v. Stinnie, #SCOTUS made it harder for civil rights plaintiffs to recover fees as prevailing parties. But Congress can and should change underlying law, argues Cato's Thomas Berry, to designate a party "prevailing" if it wins a preliminary injunction before a case becomes moot.

Re: stripping citizenship, look. There is no legal mechanism for him to do it. The very fact that he is talking about it tells you, yet again, what he is. He’s an aspiring totalitarian who wants absolute power over people’s lives and to use it to reward friends and punish enemies. That’s really it.

They dont have arrest authority, so "resisting arrest" is not in fact the justification they think it is. Nor do they have jurisdiction over criminal law (like assault).
The problem is they do have an extremely low burden of proof on immigration stops (reasonable suspicion).

Another ICE "assault" case unravels. Border Patrol and ICE are arresting US citizens and then after they find out that they are US citizens, they are charging them with "assault" to justify their actions. This is clearly DHS policy at this point. We've seen it repeatedly now.
