Judges often describe the courts as the last line of defense for constitutional democracy. But a last line of defense that declines to defend is not neutral. It is complicit.

I wrote this piece about popular constitutionalism last year, but I truly don't think I could have possibly imagined then that we'd be watching the people claim power over the Constitution like we have for the last few months in Minnesota.

easy slogan for the next democratic presidential candidate is “i will reform the corrupt supreme court and repeal citizens united”
“When Citizens United was decided in 2010, billionaires had spent $18 million on the 2000 election, $13M 2004 and $16M in 2008. Then came the deluge. In 2012 it was $231M, and nearly doubled again in next three election cycles —to $682M in 2016, $1.2 billion in 2020 and $2.6 billion in 2024.” Gift:

Power concedes nothing without a fight. The news of the draw down this morning is a development that was won by the power of neighbors joining together to keep each other safe. We celebrate the wins.

Yet we know the threat is not over, and so our fight is not over.

Another federal court has rejected the administration’s attempt to detain people incommunicado. The Constitution does not disappear inside immigration detention. 👇
BREAKING: We won a court order requiring DHS to immediately restore meaningful access to lawyers for people detained at immigration detention centers in Minneapolis.

Access to a lawyer is not optional; it is a fundamental right. We will keep fighting to defend it.

1/3 For most of its history, SCOTUS has been a brake on democratic change, moving only when public opinion makes it inevitable. But as @skennedy2504.myatproto.social writes, in a world of “alternate facts” shaped by Fox News, its disconnect with public sentiment has never been deeper. ⚖️📺🧠

🏦 As federal agents sow terror throughout our communities and the Trump Administration accelerates its slide toward authoritarianism, Big Law is nowhere to be found. What will it take for #BigLaw to stand up for our rights and the Constitution?
My law firm is currently litigation 81 voting and election cases in 40 states. This includes 11 redistricting lawsuits. It also includes 26 cases where we are litigating against the DOJ.

Elias Law Group only has 60 lawyers. Big Law firms have 1,000-2,000 lawyers. Where are they in this fight?
