My constituent, Wilmer, was mauled by an ICE attack dog despite the fact that, as he has consistently explained, he was not resisting arrest or trying to flee—his wife and young children, all U.S. citizens, were forced to watch helplessly as Wilmer was violently attacked and dragged away.

People spend much too much time trying to calculate the legal reasoning or strategy of SCOTUS, whereas I think it's pretty simple. Roberts et al are members of conservative elite culture, and they tend to go where that follows. Ten, maybe even five years ago, they were against this. Now they're not.
