In my ongoing thread, here is the start of the DOJ portion of today's Minnesota v. Noem hearing over the 10th Amendment challenge to Operation Metro Surge. —>
We're back, and DOJ is up.

Menendez is asking Brantley Mayers for DOJ whether the purpose of the surge is to get the state and cities to change their policies and follow federal polices.

Mayers tries to say that the goal is to enforce federal law, but Menendez is pointing to admin statements.

Fox: You remember Kyle Rittenhouse. I am sure there are people on the conservative side who are saying, 'You mean you can't take a firearm to a protest? You were just celebrating the guy for doing it a couple of years ago.' Alex Pretti's firearm was lawfully carried. He didn't point it at the cops.

Menendez asks what she does with the Trump admin's claimed basis for Operation Metro Surge. Does she have to choose between their choice v. the state and cities' choices.

Essentially, Carter says that the facts show the federal government's reasons are pretext, so she doesn't have to choose.
