The transcript and footage of the CBS 60 minutes interview provide no evidence of an FCC rule violation.

I see no reason to continue pursuing this investigation.

Gomez issued the following statement after an unprecedented move by the FCC to open a proceeding and release materials from an active investigation: “The transcript and footage of this interview provide no evidence that CBS and its affiliated broadcast stations violated FCC rules. Having now seen these materials, I see no reason to continue pursuing this investigation. The FCC should now move to dismiss this fishing expedition to avoid further politicizing our enforcement actions. “It is unprecedented and reckless for the FCC to disclose the status of an active investigation and publicly share materials before its conclusion and before they’ve been shared with other members of this independent body. The agency’s Enforcement Bureau generally treats highly sensitive matters with confidentiality and discretion because they can have market impacts. This action sets a dangerous precedent that threatens to undermine trust in the FCC’s role as an impartial regulator. The FCC should stop trying to keep up with this Administration’s focus on partisan culture wars and return to its core focus of protecting consumers, promoting competition, and securing our communications networks.”

Donald Moynihan, a professor of public policy at the University of Michigan, also answered by email: “Vought is Trump’s Thomas Cromwell: the behind-the-scenes fixer who enables his master’s goals.” Vought, Moynihan added, has spent the past four years mapping out what a second Trump administration would look like. He was given responsibility by Project 2025 to map out a secret 180 Day Playbook that we are seeing play out now, in the forms of executive orders and memos. Moynihan believes Vought is an “ideological crank,” which, Moynihan argued, means that Vought will use his skills in ways that break government, rather than allow it to better serve its citizens. In many respects he does exactly what he accuses his enemies of doing. He almost single-handedly created the “weaponization of government” trope, and now President Trump is promising an era of retribution. Vought complains about a post-constitutional order, while also proposing to ignore the law, such as in the area of impoundments.

All true. Even were it not, one could argue that, given the authority Musk is exercising, and his lack of accountability to anyone (other than perhaps Trump), he is serving as a principal executive officer under the Appointments Clause, and is acting unlawfully unless confirmed by the Senate.
