Pretermiting is happening in IC courts everywhere. It is a quasi-"legal" rule allowing ICE lawyers to "pretermit" asylum seekers following the legal process to - legally - stay in the US. Think of it this way: the feds are kettling immigrants to a courtroom to have them removed without cause.

We don’t have to look to historical examples for everything - we can instead imagine a version of the future where post-violence social cohesion doesn’t come at the cost of ignoring/forgetting about something until the people who did it are in their 80s

I’m sorry but as someone who has a book and a PhD on this exact thing, this is just straight up not true. The majority of Nazis discovered living abroad (particularly in the US, Australia, and UK) faced almost no legal consequences beyond the occasional loss of citizenship.
This is essentially what governments did in the late 1900s and early 2000s with respect to Nazis. Whether you were a lowly concentration camp guard or in Hitler's inner circle, if there was evidence you were a Nazi, it was straight to jail with your walker.

It worked.
Maybe instead of identifying specific ICE agents who do particularly heinous things, we could just penalize everyone who was on payroll at the agency starting by a certain date.

People figuring out pretermition is a thing, it's been a thing. New third party states popping up all over the place (like Uganda) TPS revocation for Somalians predicated the idea Somaliland is a part of Somalia (1960 borders) yet Israel - backed by the US - declared at the UN Somaliland statehood?
January 24, 2026 at 3:14 PM
Note: IC court observers, Friends of the Court (like me) have been sounding this alarm for a while. Welcome newcomers to this pretermitting nightmare. We live it every day in IC courts everywhere.
People are missing a big thing about the saga of the detained 5-year-old. When Vance calls the father an "illegal alien" it seems to reflect a little-known Trump admin move that attempts to nullify asylum claims before they are even heard.

This policy is a horror:

The Trump Administration’s ongoing occupations of peaceful American cities are unconstitutional and illegal.

Boston is leading a coalition of cities supporting the lawsuit by the State of Minnesota, Minneapolis, and St. Paul to end their occupation by more than two thousand federal agents.

Listen Slingblade McEyeliner - they are already in prison. But you liars know that. Also CNN there is no debate about busting down doors without a judical warrant. Stop it with that bullshit framing. kstp.com/kstp-news/to...

So it seems DHS's game is they lie about dangerous criminals to bust down doors in Minnesota (and all over). In Minneapolis it seems blatant AF - DHS/ICE are alerted by DOC when this happens. It's a MN policy. kstp.com/kstp-news/to...

Here in Minneapolis, hundreds of clergy from all over the country have been deployed into the streets to participate in ICE/DHS watch.

The hail from a range of religious traditions, and have come from all over.

This particular group is in a heavily immigrant neighborhood.

🚨HOLY CRAP. An ICE whistleblower just revealed a secret memo authorizing ICE officers to break into homes without a judicial warrant, which DHS's own legal training materials say is unconstitutional!

ICE then hid the memo from the public, passing it along by word of mouth and private conversation.

This is the tidbit I found from NYTimes: re the 8th circuit administrative stay re: go ahead and pepper spray people, ICE. Plaintiffs are responding.
Thanks! found this - it's an administrative stay that is going to be answered by plaintiffs soon. Not sure how this works on the ground as ICE doesn't listen to anyone.
January 21, 2026 at 8:41 PM
Okay - so the 8th Circuit issued an administrative stay re: ICE bullshit in Minnesota - not a ruling (yes it still sucks). But this isn't a done deal - Plaintiff/ACLU will submit a response, hopefully get ruling in favor on merits.
January 21, 2026 at 8:37 PM
Can someone tell me where to find the ruling that the 8th circuit ruled on the Gov't appeal to start pepper spraying protestors? I only find that the appeal was allowed and no ruling on motion....? At least not in the 10 - 11 window? I'm missing something?
