In 1971, Nixon imposed a 10 percent tariff for 127 days, ending once countries agreed to a favorable currency arrangement.

Trump passed that mark last Thursday, August 6, which marked 127 days since "Liberation Day."

First off, if you’re getting means-tested benefits while working a full time job, it’s probably because you have children that raise your eligibility threshold. So this is basically a big “don’t hire parents” incentive for companies.

As for the constitutional issue, don't call it a tax or duty. Set up a special purpose vehicle not at Treasury. Call it "profit sharing." Bonus if it's disconnected from the volume of items exported.

Specifics around instrument choice will matter here.

Export Control Reform Act of 2018 says "No fee may be charged in connection with the submission, processing, or consideration of any application for a license or other authorization or other request made in connection with any regulation in effect under " ECRA.

I know that the IEEPA litigation has a lot of folks debating whether "regulate imports" (including through embargoes) could include tariffs.

But it seems like Trump could easily get around prohibitions on "fee" or export taxes by taking ownership of shares.

Whether this is legal will depend a lot on the specifics. A deal structured as an equity stake is unorthodox but probably legal. A straight impost on revenue or profit looks more like a prohibited export tax.

Export controls got around this because they weren't for sale.

OTOH, it takes export controls - which operate through a high fence, small yard logic to protect national security - and puts a price on it. The administration is taking something that should be sacrosanct, and making it something countries/companies can negotiate around.
