The most notable thing about Pope Francis to me is that the worst people in Christendom hated him almost universally. I can think of no more ringing endorsement of a person's character than that. For the sake of the world, I pray that the next Pope will similarly defy humanity's worst impulses.

Rubio’s position seems to be:

- We get to say who is a terrorist. Our decision is final. It can’t be challenged. Just trust us.
- Once we decide you are a terrorist, we can immediately deport you. No judges.
- After we deport you, we can make you rot in a foreign prison. No criminal charges needed.
On Hugh Hewitt’s show, Marco Rubio says El Salvador is “housing” people sent by the US. But he never says on what possible legal authority? These people haven’t committed any crime in El Salvador and by their own admission “many” have never committed a crime in the US. It all seems entirely lawless.

NEW today from @miamiherald.com: more men sent to El Salvador on Saturday have been identified by their families, including a 27-year-old who entered legally at a port of entry in 2023 through the CBP One app and a 29-year-old father of a baby born here last year. Neither have any criminal record.

Holy crap. The DOJ is arguing that the President can unilaterally deport anyone he wants without ANY statutory authority, just on his inherent authority as President over national security.

That is a terrifying claim to make and not one that has ever been recognized before in US history.

In 1999, the Board of Immigration Appeals ruled that the answer to that was essentially no. So long as the Secretary of State's invocation is "facially reasonable and bona fide," an immigration judge may not inquire any further and must accept the Secretary's assessment.

!! This seems to confirm that the Trump admin invoked an obscure Cold War-era law, INA 237(a)(4)(C), which authorizes the Secretary of State to *personally* order any noncitizen to be deported on the grounds that their presence "would have potentially serious adverse foreign policy consequences."

Two things:

- Rubio’s involvement makes it even more likely they invoked the obscure law which lets the Secretary of State declare a person’s presence harms foreign policy.
- This is not “revoking” a green card, as if it happened already. They will still have to go through immigration court first.
A White House source tells The Washington Post that Secretary of State Marco Rubio was directly involved in the revocation of Mahmoud Khalil’s green card, which suggests that DHS knew he was a legal permanent resident – not on a visa – when they arrested him. www.washingtonpost.com/education/20...

By the time you get to green card holders, ICE prosecutors have to articulate a ground of removability (listed in U.S. law), tell an immigration judge the person has violated it, and get the judge to agree.

That is still a much lower level of protection than citizens — of any sort — have. +

Unlike, say, someone who’s paroled into the U.S., ICE can’t just strip someone with a green card of legal protections _by_ arresting them. Nor is it like a non-immigrant visa, where, say, State can unilaterally revoke, but for a specific reason (eg you were working not student-ing). +

Aaron's tweets often remind me TV shows when characters get sent to a different dimension and they're horrified at all the vampires and zombies, only to encounter a mild guy who's been there for years, sipping tea, "Oh, all the monsters. Yeah, that's why they call it Nightmare World."
There's a lot of confusion swirling so it may help to explain that the below is actually fairly normal following an ICE arrest. ICE often transfers people to the deep South where some of the largest detention centers are located, and the ICE Detainee Locator system can take up to 24 hours to update.
Until last night, the ICE detainee locator stated Khalil was at Elizabeth, NJ—even though his wife had been unable to find him there yesterday. This morning, his location has been updated to Jena — a very remote, GEO group-run facility in the middle of rural Louisiana.

Some products cross the U.S. border even more than that.
