Shout out to @mmasnick.bsky.social. I asked Grok some questions about Section 230 and Grok thinks Tech Dirt is a great reference to debunk lies from Ted Cruz and Josh Hawley about Section 230.

Democracy is burning, and we need sites like Bluesky more than ever. And Senator Durbin wants to repeal 230, which would massively stifle the ability of sites like Bluesky to exist, while massively empowering X and Meta.

Why?

It seems that someone in his office doesn't understand 230.
It’s time to repeal Section 230. We must be able to take social media companies to court for addicting kids and enabling drug trafficking on their platforms.

Sen. DURBIN: Fentanyl often gets to our kids and young people through the internet.

Section 230 absolves social media companies from any responsibility. “That has got to end.”

"The MAGA response playbook has become pathetically predictable: celebrate policies not for their outcomes, but for how many (and which) people they hurt. It’s governance by spite, where “owning the libs” has replaced any pretense of actual policymaking."

It appears Mr. Fyk doesn't like free speech when people shine a big spotlight on his dumb Section 230 lawsuits.

I appreciate you folks shining a big spotlight on guys like Fyk to explain the law. Keep publishing about his "golden" failures

I have no problem with porn but another reason X sucks is because I get insta likes the second I reply to someone with bots. I know bots are everywhere but Musk also gets losers to pay him a lot of money to clean this shit up, and they are everywhere.

More proof to show that the core arguments Republicans presented in Biden v. Murthy was pure partisan bullshit from Republicans to go after and damage Biden.

Especially with a Trump appointed lower court judge deciding that Biden violated the 1A on the 4th of July when the courts aren't even open.
If a Dem FCC commissioner had done anything even hinting at what Brendan Carr did in this letter, I guarantee that Brendan Carr would have freaked out and screamed about creeping authoritarianism.
Exclusive: The incoming chairman of the FCC is sending a stern message to the owners of TV stations and networks. And he is using ABC’s recent settlement with Trump as a news peg of sorts. Here's my latest story >>> www.cnn.com/2024/12/23/m...

I'm so sad Jason Fyk has me blocked on the other site for trolling his Section 230 losses.

But since Musk destroyed how the block function works, I can now see all of Jason's cope tweets. They are so funny. 😂

Congress crafted section 230 in 1996 to ensure this can't happen to website after the Wolf of Wall Street sued and won because users on a website called him a fraud.

Section 230 (c)(1) shields you the same way it shields Facebook and Twitter every single time you repost on Bluesky, Twitter, Facebook, and forward emails you never typed.

Claiming it is only a shield for the rich is a blatant lie.

TL;DR: Jason Fyk's repeated legal battles against Facebook over content removal continue to be thwarted by Section 230, with the Ninth Circuit upholding the lower court's decisions against him.

In 2018, Jason Fyk sued Facebook for removing and blocking his content. My previous summary of this litigation campaign: His lawsuit against Facebook was dashed by Section 230 in the district court. The Ninth Circuit quickly agreed and then denied his en banc...

Jason Fyk lost his Section 230 fight vs Facebook (again). A few months ago he was super OVER confident things would go his way.

A judge already told Musk that he can't claim he owns user content while also claiming he is immune under Section 230 because those posts are third party.

The title of section 230 law explicitly says it's about content moderation.

You're either a liar or just unable to read.

1. Social media servers are on private property.
2. Not a utility.
3. Not like Verizon.
4. They can cancel you because they don't agree with you because of the 1A.
5. They can control speech because of the 1A & Section 230.
6. Make your own website like Truth Social if you don't like it.

The government can't regulate Bluesky or any website to carry speech they disagree with. Read the First Amendment of the United States Constitution if the words in it aren't too big for you.

Elon Musk can bake the custom cake that the hateful bigots at LibsofTikTok are looking for if Bluesky won't bake it for them.
