The Senate is now preparing to vote on extending these credits, a vote forced as part of the agreement to reopen the government. This extension is essential, and I urge you to support a clean renewal of the ACA premium tax credits without delay. Unfortunately, Senate Republicans have now introduced the Crapo-Cassidy bill as their counterproposal. While marketed as a plan to address premium spikes, the bill is filled with provisions that would dramatically restrict access to both abortion and gender-affirming care, and would destabilize health coverage nationwide. These provisions must not become bargaining chips in any negotiation. The Crapo-Cassidy plan: • Replaces ACA premium subsidies with small HSA deposits that do nothing to offset real premium increases. • Bans HSAs from covering gender-affirming care for people of any age. • Strips gender-affirming care from the ACA’s Essential Health Benefits, allowing insurers to drop coverage entirely. • Bans Medicaid from covering gender-affirming care, cutting off the only affordable option for many low-income trans Americans. • Includes new abortion-related restrictions, embedding an ideological agenda inside what is supposed to be a health-care affordability bill. These provisions have no place in must-pass health legislation. They are not about solving premium spikes—they are part of a long pattern of attempts to weaponize health policy against transgender people and those seeking reproductive care. Similar riders appeared in earlier GOP proposals, in shutdown negotiations, in defense bills, and even in the so-called “big beautiful bill.” Each time, these attacks have been rejected. They must be rejected again. We should not allow Republicans to hold affordable health care hostage in exchange for stripping medically necessary care from entire groups of Americans. Gender-affirming care is life-saving and recognized as medically necessary by every major U.S. medical association. Abortion care is essential health care. No extension of ACA subsidies should be conditioned on denying people the care they need. Congress must act now to prevent a nationwide premium crisis and protect millions of families from financial devastation. A clean extension of the enhanced ACA tax credits is the only responsible path forward. I urge you to: 1. Support a clean, immediate renewal of ACA premium tax credits. 2. Oppose the Crapo-Cassidy bill and any health-care proposal that includes restrictions on abortion or gender-affirming care. 3. Reject all attempts to use transgender health care or reproductive rights as bargaining chips in essential health-care negotiations. Affordable health care should not be a battlefield for ideological attacks. Protect the ACA. Protect families. Protect medically necessary care for every American.

This includes practices by current Medicare Advantage insurers, and the planned Medicare pilot program of the so-called “WISeR” model, designed to reduce the provision of medications and services in the future. Don’t allow Artificial Intelligence to review treatments prescribed by human doctors, using their medical degrees, expertise, and clinical judgment. A recent Senate subcommittee report on the use of AI to make prior authorization decisions points to serious concerns. During the period that UnitedHealthcare, Humana, and CVS adopted AI tools, denials of authorization increased by 54% to 108%, depending on the insurer. For instance, between 2020 and 2022, when it first started using AI, UnitedHealthCare more than doubled its denials of post-acute care such as rehab facilities and nursing homes. Physicians, too, are speaking up. A 2024 AMA survey of 1,000 physicians (including 400 Primary Care Physicians and 600 specialists) found that 61% reported that the use of AI increases denials and harm to patients, and 49% ranked AI-based authorization decisions as one of the top three priorities for health legislation. Medicare Advantage’s use of AI resulted in sharp increases in delays, denials, and lawsuits, and the upcoming pilot program for traditional Medicare puts more patients at risk. Don’t let CMS sell out patient care to AI corporations. Thank you for helping to safeguard Medicare to provide the best of care for our nation’s seniors and people with disabilities.
