It's not right that people who merely have a medical degree and an opinion should have arbitrary access to personal medical data of trans patients without having to show to those patients that they are conducting research in good faith.

Aye. Without the ECHR, the far right Government of the day can repeal the GRA on a whim. They probably would. I think Badenoch would, certainly.
But all we can do in the meantime is be loud, visible and fight using all the avenues available to us.

Another factor to consider is that the government has apparently conceded that trans-inclusive gendered services and facilities “might be” lawful, without going so far as to say they “are” lawful.

Honestly, I wouldn’t pursue the case now that the interim guidance has been withdrawn.
That said, I think the potential benefits far outweigh the risks. Another endorsement from the judiciary wouldn’t make much difference anyway, but a disapproval would be far more consequential.

However, if the court examines the full merits of the case and rules against the GLP on domestic law, it should then consider making a declaration of incompatibility under the Human Rights Act. If it refuses to do so, it would in effect be creating “bathroom law”, which would be a serious matter.

It depends on how the GLP lose the case. If the court rules on a narrow administrative law basis, deciding only that the guidance cannot be reviewed, then there is very little cause for concern.
