Except, that's exactly how the system works.

Maybe the judge is wrong, maybe not, but the judicial system checks the executive and there is an appeals process. It might very well be the valid opinion of someone that a court has ruled in an unconstitutional manner, but that is within their power.

These are not serious people and can't do basic fact checking, but they do vote.
