This who are interested in executive power have to read this paper. It’s destined for the Harvard Law Review or Yale or one of the “big” ones.
Thanks so much for your engagement with my work, Mike and Larry. More TK soon! Mike’s points about “core” executive powers over law enforcement touch on some of my earlier work, so I’ve included a few thoughts below.

The Loyola Constitutional Law Colloquium is a gem of a conference. Met some brilliant people for the first time and got to reconnect with old friends.

I also got amazing feedback on my “Presidential Penumbras” project.

Alito is trying to clear the way for the Trump administration to use an alternative statute--section 338 of the 1030 Tariff Act--to impose tariffs. But that allows tariffs only up to 50 percent, it's only been used in wartime, and the statute hasn't been used since 1949.

Gorsuch: "So, could Congress just delegate all power to regulate foreign commerce to the president?"

Obvious answer: "Um, no."

Oh, Gorsuch is a "no". Wow.

KBJ, Kagan, and Sotomayor are clearly against the administration.

Barrett seems to be likely to join them as well as Roberts.

I’m interested for Gorsuch to speak up. His whole shtick is “get the government off normal peoples’ backs.”
