Download of the Week: “Abstract Review in Article III Courts” by West
The Download of the Week is Abstract Review in Article III Courts by E. Garrett West. Here is the abstract: Federal courts are supposed to engage in judicial review only in concrete cases and controversies. Many European constitutional courts, by contrast, engage in abstract review of legislation. But a combination of features of adjudication in the United States produces something functionally like abstract review of government policies, even while the formal justification for judicial review remains the dispute-resolution function.

It was an honor to be with other OT13 Supreme Court clerks to support our friend Sparkle Sooknanan at her investiture as a federal judge on the U.S. District Court for the District of Columbia. The country is better off because of Sparkle's service.

Erik Siebert, like Danielle Sassoon, is an excellent lawyer I know and respect--and now a former U.S. Attorney, after pursuing justice without fear or favor. He's a former police officer who has dedicated his life to public service. What a sad situation. (Gift link in next post.)

Hi! 👋 I'm excited to have a new draft article--"Ex Parte Young Redux"--that analyzes Young doctrine after CASA. I argue that in limited circumstances like the challenge to Texas's then-unconstitutional S.B. 8 abortion ban, people should be able to sue (gasp) states themselves ⬇️
