PLAINTIFFS' OPPOSITION TO DEFENDANTS' MOTION TO MODIFY SCHEDULE At 6:43 p.m. yesterday, the United States Supreme Court issued an order finding that this Court "properly require[d] the Government to 'facilitate' Abrego Garcia's release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador." Noem et al. v. Abrego Garcia et al., 604 U.S. _ (2025), slip op. at 2. The Court further ordered the Government to "be prepared to share what it can concerning the steps it has taken and the prospect of further steps." Id. Last night, this Court ordered the Government to file, no later than 9:30 a.m. today, a declaration from an individual with personal knowledge, "addressing the following: (1) the current physical location and custodial status of Abrego Garcia; (2) what steps, if any, Defendants have taken to facilitate Abrego Garcia's immediate return to the United States; and (3) what additional steps Defendants will take, and when, to facilitate his return." Dkt. 51. This Court's order to facilitate Abrego Garcia's return was issued one week ago. It was not stayed until Monday afternoon. Accordingly, the Government should have been taking actions Friday, Saturday, Sunday, and Monday morning, and the Government can report on those. The Supreme Court lifted the stay yesterday evening. Accordingly, the Government should have been taking actions last night and this morning, and it can report on those. The Government should likewise be in a position to tell the Court in general terms what its further plan is to facilitate Mr. Abrego Garcia's return, and who in the Government is responsible for implementing that plan. Instead, the Government continues to delay, obfuscate, and flout court orders, while a man's life and safety is at risk. Its request for an extension- filed this morning in defiance of the Court's rules requiring consultation with Plaintiffs' counsel-is another stunning display of arrogance and cruelty. It did not take that time to ponder whether to remove Garcia-which it effectuated within 72 hours of his unlawful seizure and it does not need that time to comply with this Court's and the Supreme Court's rulings. We vigorously oppose the Government's motion, and we further request that the Government immediately report on Mr. Abrego Garcia's safety and well being. RESPONSE TO AMENDED PRELIMINARY INJUNCTION ORDER Defendants are unable to provide the information requested by the Court on the impracticable deadline set by the Court hours after the Supreme Court issued its order. The Supreme Court's order directs the Court to "clarify its directive, with due regard for the deference owed to the Executive Branch in the conduct of foreign affairs." Abrego Garcia v. Noem, 25A949, 604 U. S. _ (2025), Op. at 2. The Court has not yet clarified what it means to "facilitate" or "effectuate" the return as it relates to this case, as Plaintiff is in the custody of a foreign sovereign. Defendants request— and require-the opportunity to brief that issue prior to being subject to any compliance deadlines. Needless to say, Defendants were under no obligation to take action under the court's order while it was administratively stayed by the Chief Justice of the United States. In light of the insufficient amount of time afforded to review the Supreme Court's Order following the dissolution of the administrative stay Case 8:25-cv-00951-PX Document 59 Filed 04/11/25 Page 2 of 2 in this case, Defendants are not in a position where they "can" share any information requested by the Court. That is the reality. Defendants received the order late in the evening last night. They are reviewing the order and actively evaluating next steps. It is unreasonable and impracticable for Defendants to reveal potential steps before those steps are reviewed, agreed upon, and vetted. Foreign affairs cannot operate on judicial timelines, in part because it involves sensitive country-specific considerations wholly inappropriate for judicial review.

“Skadden is on the wrong side of history. I could no longer stay knowing that someday I would have to explain why I stayed,” the lawyer, Thomas Sipp, wrote in his resignation letter.
Resignation Dear colleagues and friends, I just spoke to many of you. Thank you for listening. I am writing to let you know that I am leaving this firm. There was a time when my employment here was so unlikely. For much of my early childhood, I was not a good student. I struggled to focus in class and take anything (other than my friendships) seriously. But even then, there was one subject I loved: history. I thought it was so wonderful to learn about all that came before me, about the triumphs and tragedies, about the moments of individual bravery and collective complacency. And I loved recognizing the patterns in the stories across time and space. This rhyming nature of history informed and continues to inform my deeply held belief-that self-evident truth-that all humans are created equal. And that our individual differences are the product of our times and circumstances, and that who we are is shaped by what we choose to do. While learning about these stories, many of them avoidable tragedies, I would often imagine myself faced with the same dilemmas. What would I do if I was there? Would I do the right thing? It always felt like there was no way to know. < 297 Resignation く I believe, as I know many of you do, that what the current presidential administration is doing is wrong. That we are sliding into an autocracy where those in power are above the rule of law. Skadden's agreement with the Trump administration sent our country deeper down this descent. I am sure some of you will question my decision and chalk it up to me being a young attorney too eager to throw his career away. I am sure there will also be those of you who will think of me as naïve. But there was a time when I sincerely believed that this place was committed to its true pro bono causes and diversity initiatives, even though these things may not always be lucrative, because it believed these things would make the world, and this firm, a better place. Having held itself out as a champion for these values, for this firm to turn its back on them so suddenly and so easily was shameful. I am embarrassed to work here. How can Skadden represent others when it can't even stand up for itself? It has also become clear to me that this firm no longer tolerates open discourse. Ahead of Friday's announcement, the firm took preemptive action to silence critics by covertly limiting our access to firmwide distribution lists. This was a clear effort to silence criticism of the firm's decision. The consequences of Skadden's agreement with the Trump administration go beyond our own firm. It legitimized behavior that threatens our democracy. As lawyers, we have an obligation to uphold the rule of law. This responsibility does not end when profits are threatened by a burgeoning autocracy. I am making this decision to leave even though I was happy here. I have made so many great friends at this firm and learned from many great mentors. Thank you so much, I will miss you all dearly. And I am making this decision knowing that not everyone can leave as readily as I can, that many of you have families who depend on the income you earn here—I do not mean to shame you into leaving, only to explain my decision.
