Important to understand this. There's a reasonable chance that your Dem Senator who voted against it and is acting mad now was in on the play. It's the same reason why they scheduled the surrender for AFTER the election this week. They didn't want people pissed at Dems right before an election.
The caucus meeting was just to orchestrate who would fall on the sword but not be up for a vote in 2026.

Kavanaugh says that IEEPA would allow Trump to shut down trade with other countries but not impose tariffs. He calls that the "donut hole" in their position. Oregon's SG Gutman replies tariffs are a tax, the other isn't.

"It's not a donut hole: It's an entirely different pastry."

I can just as easily seeing Roberts invoking the major questions doctrine to strike down the Trump tariffs and getting an easy join from Barrett and Gorsuch, all so they can force the liberals to accede to a made-up theory they've only ever protested.

Congress actually explained to us in its Senate report and House report in the Trading with the Enemy Act (IEEPA's predecessor) that the law allowed the President "to control or freeze property transactions when a foreign interest is involved."

Not raise revenue.

Chief Justice Roberts notes (correctly) that IEEPA had "never been used to justify tariffs," following up with a question of the major questions doctrine.

"It does seem like that's major authority and the basis for the claim, seems to be a misfit."

Justice Kagan picks up on Justice Barrett's line of questioning, pointing out that Sauer's citation relates to IEEPA's predecessor: the Trading with the Enemies Act.

IEEPA leaves some of that language in, but Kagan note: "It just doesn't have the one [i.e. the language] you want."
