Sources tell me all of the court employees in Sedgwick County (Wichita) received an email reminder this week that the Kleenex in the courthouse is not for their use and they have to bring their own. Which is the most ridiculous thing I’ve ever heard.

My advice to young litigators: don’t be afraid to lose. Don’t be afraid to look foolish. Look at every bad fact as an opportunity to spin it into your strongest fact. Don’t send that email. Pick up the phone instead.

Having tried 12 civil jury trials since 2021 in some very pro-Trump rural venues, my impression is juries are perhaps getting better. At least for personal injury plaintiffs. The panel walks into the courtroom distrusting me and my clients. They walk in hating the idea of noneconomic damages.
And what does it tell you about our juries? Anti-Government, less trust in the government, or more quick to jump to conclusions based off of stereotypes, implied or apparent bias, freedom to be more racist… So many contradictions - unless your client is Hispanic or female.

I’m wondering what it would take to get Biden to fill the D Kan judge vacancy before he leaves office. We’ve been down a judge for his entire term. Would be nice to have a left of center judge—with trial experience please.

This whole election cycle has made it so much easier to explain to my clients what I mean when I say “juries are unpredictable.” The things you think are important often aren’t to the people who are voting on your case. The things you think don’t matter are often the case deciding facts.
