A vehicle's size (esp of its hood) affects safety as well as its mass. To some degree we can & should regulate that directly, but generally if an EV and an ICE are the same weight the EV will be smaller and safer, so I think it's fair to allow EVs a bit more weight before the restrictions kick in.
