What does it mean for a STATE to have genocidal intent? (1) The archetype is an official policy to destroy a group, authored by political and military leaders, systematically implemented – a clear cut but not that common instantiation of state intent.

I spoke with @thejournal.ie this week (along with @janinadill.bsky.social and @dirkmoses.bsky.social) to discuss some of the criticisms of @amnesty.org's recent report on #Gaza and whether Amnesty has invented its own definition of genocide (short answer: no). www.thejournal.ie/amnesty-inte...
Why is Israel accusing Amnesty International of inventing its own definition of genocide?
Amnesty recently concluded that Israel is committing genocide against the Palestinian people in Gaza.

“More than genocide.” Published a year ago. Permanent security aspirations have been indicted by the ICC, though not seen as genocidal. We need to think outside the genocide box, a flawed concept and law from the middle of the last century.

Amnesty International:

“Our damning findings must serve as a wake-up call: this is genocide and it must stop now”.

It marks the first time Amnesty has alleged the crime of genocide during an ongoing conflict…

So instead of pushing through on this, it's a good time to reconsider why the assessment that this is genocide has moved into the mainstream. Israel is isolating itself further and further internationally. It's simply not the right path forward. #Israel #Gaza #genocide
It is going to be harder and harder for #Israel to dismiss #HumanRights organizations, courts, researchers, scholars and others calling its actions a #genocide. Can they really ALL be antisemitic? No, they can't. #Gaza

Legally, the ICC Statute provides for the following: The 124 state parties must treat and implement all ICC arrest warrants in exactly the same way. Questions regarding the jurisdiction of the Court or immunities are to be examined *by the ICC* in the proceedings and not by the individual states.

Art. 127 of the Rome Statute permits the withdrawal. Arguably if you think the ICC is now counterproductive you should withdraw rather than actively arrange a show of you defying the rules of the treaty.

Perhaps the most symbolic value of the arrest warrants lies in preserving the ICC’s already crumbling image against this arrogant belief:

On Nov. 13, Secretary Blinken, in the Biden administration’s ongoing effort to blame Hamas for the lack of a ceasefire deal, claimed they had been so unwilling to negotiate that Qatar told them to leave. However, on Nov. 9, Qatar's foreign ministry already called these reports "inaccurate."🧵
