According to sources, you can't move someone with a Public Safety Factor (PSF) designation - which Maxwell had - without waiving it. That's what happened here.

i AM a longtime fan and my thoughts are exactly the same
I won’t pretend to be a South Park fan, not really my jam, but here’s what I got out of their most recent episode: 1) it’s still gross, 2) it was extremely funny, 3) it was a case study in gamesmanship, 4) everyone should watch it, especially people who don’t gravitate to South Park or its style.
