According to the declaration, she received the first indictment with a no bill on one count at 6:40, then went straight to court for it to be read at 6:47. Not only did she not go back to get a second indictment, there wouldn't be time to go through the formal process.

When the judge ordered her to provide the GJ transcripts, that wasn't in there, so he assumed she left it out—fair assumption since she had already had to be ordered to supplement once. Instead of supplementing, they filed a declaration saying there was noting more.

Then, for some boneheaded reason, she gave the two inconsistent indictments to the judge. The judge was puzzled, but assumed that Halligan had presented the second indictment to the grand jury, which would involve going through some of the basic procedures like giving the formal instructions.

This is another example of DOJ creating new problems by trying to get out of previous mistakes. It looks like Halligan wanted to save face when she got no-billed on one of the counts, so she prepared a new indictment with only two counts to make it look like the GJ agreed with her on everything.
