Historian of Reconstruction here the Supreme Court is behaving like its predecessor in the late 19th century when it gutted the Reconstruction constitution and federal civil rights laws. It refused to implement the 14th amendment against Trump and now he has a blank check to upend our constitution.
it is the Imperial Judiciary when courts say that presidents can’t unilaterally overturn constitutional text, and the Proper Order of Things when courts say that your rights rest on the whims of who happens to be in office
Woah. Fierce cut-down of the junior justice by the next-most-junior justice.

This Christian theocratic project—of which SCOTUS is a crucial part—depends on kids growing up to be bigots.

Kids aren’t born to hate. They learn it. We can’t have kids learning to respect differences because that’s how you get communism so we gotta keep letting kids be indoctrinated into bigotry.

Justice Ketanji Brown Jackson cites the Colored Conventions Project Digital Records. That's the ongoing digital humanities project that rediscovers relatively underrepresented political events in American history. @ccp-org.bsky.social
There's something really interesting going on here methodologically in Justice Jackson's Medina v. Planned Parenthood dissent. You can see it in one footnote.

In short, Jackson is emphasizing that Black Americans are part of the original "public" about which "originalists" should be concerned.
