These people are by definition not criminals, because conviction for one felony or two misdemeanors is an absolute bar to TPS.

ICE has been taking the position nationwide that its field offices, and the detention cells therein, are not facilities "operated by or for [DHS] used to detain or otherwise house aliens," on the argument that the facilities are "processing areas" and therefore not covered detention facilities.
