Shop staff told to question trans customers Stores allowed to refuse entry to changing rooms under new guidance from the equality watchdog ‘The draft EHRC guidance reflects the law, so there can be no more excuses for failing to follow it’ The Daily Telegraph21 May 2025By Daniel Martin DEPUTY POLITICAL EDITOR SHOPS and leisure centres can question transgender people about their biological sex before letting them use changing rooms, the equalities watchdog has said. Those who appear to be lying can legally be refused entry as long as they are not asked in a rude or offensive manner, according to updated guidance from the Equality and Human Rights Commission (EHRC). Gyms and hospitals could legally ask people to provide birth certificates or passports to prove their biological sex. The watchdog said trans people could legally be shut out of anywhere where women were likely to be in a state of undress. Many organisations – such as the NHS and the two Houses of Parliament – have refused to change their guidance on who can access women’s spaces, even after the Supreme Court ruled that trans women were not legally women. Women’s rights groups said there was “no excuse” for organisations and businesses not to follow the new guidance. The Supreme Court ruled last month that the word “sex” in the Equality Act refers to biological sex and not gender identity. The EHRC then put out interim guidance saying that in places like hospitals, shops and restaurants, “trans women (biological men) should not be permitted to use the women’s facilities”. A growing number of public bodies are changing their guidance in light of the judgment. The Football Association, for example, said trans women would be banned from women’s sport. But others have not done so and say they are awaiting final guidance from the EHRC. The UK Supreme Court has unanimously decided that the definition of sex under the Equality Act 2010 refers solely to biological sex, and does not include people with a Gender Recognition Certificate.
