This seems like really big news with implications for the federal govt also? Surely their view that they don’t need a climate trigger in the EPBC Act must be shaken by this?

The NSW Net Zero Commission recently advised the NSW Government that export emissions and local climate harms must be considered in proposed coal expansions.

The science and the law is clear - business as usual is no longer an option.

The case follows recent Court of Appeal decision, Denman v MACH Energy, where the court found a direct causal link between export emissions from coal, and local climate harms.

It also comes after the International Court of Justice confirmed countries will be liable for transboundary climate harms.

“Local communities in NSW are suffering from the impacts of extreme bushfires, floods and heatwaves.

“Consideration of those harms is a mandatory consideration for future fossil fuel projects, including for modifications and applications already in the system.”

It’s surprising that the Australian government appears to have taken no steps at all to respond to the recent International Court of Justice Advisory Opinion, which confirmed that continued fossil fuel production could expose countries like Australia to liability for transboundary climate harms.

The night before this project was approved, our office wrote to the Minister advising him that his proposed actions could constitute a breach of Australia’s international law obligations, after Vanuatu warned that approval of the project would represent an internationally wrongful act.
