3 class-action lawsuits filed in 2025 alone against brands and influencers are seeking a total of $1 billion in alleged damages, and influencers are STILL not clearly disclosing partnerships!
May 1, 2025 at 12:00 AM
Revolve, and 3 of their influencers, are facing a $50-million lawsuit for deceptive influencer marketing practices, failing to disclose their partnerships with the brand.

Why is the Federal Trade Commission not enforcing sustainability claims the way the FDA enforces nutritional claims?

There would be an uprising if food & beverage companies acted the way advertisers act with sustainability claims.
April 24, 2025 at 2:46 AM
Why are we not more infuriated about brands lying about their sustainability claims?!

I don't say this lightly, but from what I'm seeing, content creators and influencers are the greatest risk to the integrity of marketing. Marketing Ethics & Integrity Advisors are the future of compliant and trustworthy influencer campaigns.

The point of the Federal Trade Commission is to be an INDEPENDENT agency that protects the every day consumer. How are consumers supposed to trust an organization that now inherently can't be unbiased in its decision making?

Referencing to your sustainability goals with anything related to "zero" is questionable, and highly unethical if you have no actual means of achieving it. It may not be illegal, but it's certainly misleading to consumers when they see "sustainability" and "zero" as part of the same project/goal.

Legal? Arguably, apparently. Ethical? Not at all.

Deeply disappointed, but also, not surprised.

Self-regulation has never been so important for the advertising industry. Yet, many of the trade associations responsible for educating & enforcing self-regulation are funded by the same companies firing their DEI teams.

Coming out of the first Ad Net Zero AI x Sustainability webinar, I'm very curios how people are considering the environmental impact of AI.

Tell me: has the environmental impact of AI changed how much you use it?

Big shoutout to the people running the Watch Duty app.

I've never had any errors or lags in the app. Even with the surge in users there's been no change in loading times or speed of sharing information.

AND it's a nonprofit?! Funny what happens when you prioritize people and impact over profits.

Heading into 2025, there are two #AdvertisingLaw issues that stand out and are top of mind for me:
1. Environmental claims (greenwashing)
2. The FTC's enforcement of consumer reviews & testimonials

Here's my full take.

When I first saw this lawsuit in the headlines, I never imagined it would move forward.

Where this falls apart, for me, is that I don't think it's too difficult to find 5 more content creators with a similar aesthetic as these two.

15 years to develop new rules that STILL fail to address the real market of social media (influencers) and telehealth.

This is why stronger self-regulation (and co-regulation) is so critical to the advertising industry.
