On 4/8 (Tuesday), Judge Trevor McFadden issued a stay of his own injunction until 4/13 in the AP access case for the reason highlighted (left).

Earlier today, DOJ (c/o U.S. Attorney Ed Martin (D.C.)) filed a notice of appeal.

Tonight, this is the malarkey Martin filed with McFadden (right).
ORDER The Associated Press ("AP") moved for a preliminary injunction against the White House Chief of Staff, Deputy Chief of Staff, and Press Secretary (collectively, "the Government"). Am. Mot. Preliminary Inj., ECF No. 27. It sought to enjoin the Government from denying the AP access to the Oval Office, Air Force One, and other limited spaces because of the AP's viewpoint. The Court granted the AP's preliminary injunction request. Mem. Order, BCF No. [46]. <h>The Court now, on its own motion, stays its Memorandum Order imposing a preliminary injunction through April 13, 2025, to provide the Government time to seek an emergency stay from a higher court and to prepare to implement the Court's injunction. This stay automatically dissolves after April 13, absent further relief from a higher court.</h> For this reason, it is hereby ORDERED that the Court's [46] Memorandum Order Granting Plaintiff's [27] Amended Motion for Preliminary Injunction is STAYED through April 13, 2025. Senior U.S. District Judge John Coughenour on Thursday was blistering in his criticism of Trump’s action as he granted a temporary restraining order that blocks Trump’s executive order from taking effect nationwide. “I’ve been on the bench for over four decades, I can’t remember another case where the question presented is as clear as this one is. This is a blatantly unconstitutional order,” Coughenour, an appointee of Ronald Reagan, said from the bench. “There are other times in world history where we look back and people of goodwill can say where were the judges, where were the lawyers?” Coughenour interrupted before Brett Shumate, a Justice Department attorney, could even complete his first sentence. “In your opinion Is this executive order constitutional?” he asked. Shumate said, “it absolutely is.” “Frankly I have difficulty understanding how a member of the Bar could state unequivocally that this is a constitutional order,” Coughenour said. “It just boggles my mind.”
