A derivative case is one that an entity (corporation, partnership, non-profit) _should_ bring but won't. So courts let stakeholders (shareholders, partners, members) sue for the entity.

Yesterday in Delligatti v. United States, No. 23-825, SCOTUS held that, in sentencing, a "crime of violence" may include a failure to act by a person who has a duty to act--a crime of omission.

DOJ moved to dismiss my case, which was based in part on the Jan. 6 insurrection--not that one would learn that from DOJ's opening.
Note the sarcasm--"purported apathy." "Alleged bias in favor of personal interests." Air quotes around Chief Executive Officer.
