I haven’t had the capacity to actively post, but this needs to be said over and over again. Prof. Johnston is right. In my line of work, I’ve seen so much backlash from employers who have decided they are done performing.
Today is a good day to remember, and to say, that the #MeToo movement was right, and was righteous, and has been vindicated over and over again. There was no overreach. There was no excess. There was no they-went-too-far.

So much work remains to be done.

Look at this graph.

The share of national income going to the richest 10 percent was lowest (and share to lower 90 percent highest) when union membership was at its highest.

As unions have weakened, inequality has widened.

This is why we must build back union power.

I’m not a constitutional expert, and perhaps it’s because I am still feeling bitter, but I am over the “it won’t be so bad,” “checks and balances” takes. Rules generally work because people agreed to follow them as part of a social contract. When someone bows out, the rules don’t matter.

Grateful for this work. There have been too many of these cases (or threats) against those who speak out about sexual harassment and abuses. Even without these suits, in workplaces, I’ve seen continued backlash now that many companies have taken off their masks. Shameful.

As an employment lawyer, I’ve been thinking about how workers’ rights will be impacted. We need to continue to address issues like discrimination, paid family leave, and fair wages. I still need to deal with my feelings, but I’ve been inspired by the grace you are extending to each other. 🙏🏼
